Awesome People Leaders Authorized User Privacy Policy
Overview
Awesome People Leaders (“we”, “us”, “our”, or “APL”) respects the privacy of our customers and individuals who use our services. This Privacy Policy is designed to assist you in understanding how Awesome People Leaders will collect, use and disclose any personal information when end users use our software applications, including any and all add-ins and related services (collectively, the “Services”).
In this policy, “Client” refers to our customer who has executed a master services agreement with us, to enable us to provide our Services to its end users. Our Client may be your employer or an entity which has engaged you to perform services as a contractor or advisor. In this policy, “you” or “End User” refers to each end user who accesses the Services on behalf of a Client.
The Information We Collect
Our Clients and/or End Users may input or transfer data onto the APL systems, which may include an individual’s name, email address, phone number, business role, location, and other information which is or is reasonably capable of identifying a particular person (“Personally Identifiable Information” or “PII”).
When we obtain PII from our Clients, we process that PII under the direction of our Clients, and we have no direct control or ownership of such PII. If you are an End User of one of our Clients and would no longer like to be contacted by the applicable Client from whom you received access to our Services, then please contact the Client that you interact with directly. Our Clients are responsible for complying with regulations or laws that require providing notice, disclosure and/or obtaining consent prior to transferring your PII and other information about you to APL.
We may also collect PII when you provide it directly to us through use of the Services, including for example, when you register to use the Services (including any add-in or feature of the same), when you use another application in which the Services are embedded, and when you contact our support team.
We may also gather certain information automatically as you access and use the Services, including IP addresses, browser type, internet service provider (ISP), operating systems, access times, requests made, features accessed, and time spent on various features or add-ins (collectively, “Usage Data”). We may associate Usage Data with a unique identifier or with other information about you in our internal systems, but it is not our intention that Usage Data be independently capable of identifying you.
Use of Information by APL
We may use your PII and other information we obtain for the following purposes:
- To operate our Services, and perform or fulfill services requested by you or an applicable Client;
- To inform you of changes to our Services and/or our policies;
- To resolve disputes, troubleshoot problems, and enforce our agreements with you, including our policies;
- To verify accounts and activity, to detect, prevent, and respond to potential or actual security incidents, and to monitor and protect against other malicious, deceptive, fraudulent, or illegal activity;
- For purposes required by law or where we believe it is necessary to protect our legal rights, interests and the interests of others, including our Clients, in connection with legal claims, compliance, regulatory, and audit functions; and
- For any other specific purpose that we communicate to you upon collection of the same, and for any purpose that you approve or for which you direct us to use such information.
We may produce data and data sets which are de-identified, anonymized, and/or aggregated such that the data is no longer capable of identifying you (“Aggregated Data”). Aggregated Data may be derived from PII, Usage Data, or other information. We may use Usage Data and Aggregated Data for any lawful purpose that we may deem appropriate.
Disclosure of Information by APL
APL does not sell your PII to third parties. We may disclose your PII, and other information we obtain, to the following parties for the following purposes:
- To the Client through whose relationship with APL you have accessed the Services, to the extent necessary to fulfill our agreement with and provide Services to that Client;
- To contractors, service providers, and other third parties who we have engaged in order to continue to develop our services, improve our services, and provide the services to our customers (for example, IT service providers, such that they may support our IT systems, and provide hosting, processing, and analyzing services with respect to information and data collected);
- To the acquiring or surviving entity as part of a transfer or assignment if we are acquired by, sold to, or merged with another entity, or otherwise reorganized or liquidated;
- To relevant parties in response to legal processes, court orders, or government or regulatory requests, and/or as appropriate to investigate, prevent, or take action regarding illegal activities;
- To appropriate parties as necessary to investigate potential violations of this Policy, to enforce other agreements with you, to verify or enforce compliance with the policies governing our sites and applicable laws;
- To appropriate parties when disclosure is deemed necessary to protect us, other End Users, Clients, and third parties, if we believe that you may harm, or have harmed, APL, other End Users, any Client(s), or any third party.
Client as Controller
Please note that if we obtain your PII from and process it on behalf of a Client, that Client may direct us to use or disclose the PII in different or additional ways than as set forth herein. As described above, in such case, Client is the controller of such information and we are the processor, and it is the Client’s responsibility to confirm it has the right to use and disclose your PII (and/or direct us to use and disclosure your PII) for such purposes, We will not have responsibility to you or liability for use or disclosure of your PII in ways directed by a Client. If you have questions regarding how a Client uses or discloses your PII, you should request the Client’s internal policies.
Changes; Deletion; Retention
You may request that we delete PII we obtain directly from you. You may update or change or delete your account information at any time by accessing your information on your account or contact us at [email protected] . Please be aware that we may not be able to provide the Services, or certain portions of the Services to you, if you request that we delete your PII. We will not be required to delete PII if retention of the same is necessary to comply with our legal obligations, to resolve disputes, and enforce our agreements.
Please be aware that, as to PII we obtain from a Client about you, you should reach out to the Client to request deletion. We may pass any requests for deletion along to a Client, in our discretion, where required by law, or where we have agreed with a Client to do so.
Unless and until you request deletion, we will retain PII for at least as long as your account is active or as needed to provide services to our Client, and thereafter for such time as we may deem necessary for back-up purposes and/or for legal compliance. Further, Awesome People Leaders employs an event-based immutable event architecture. That means that events sent to Awesome People Leaders via the events or analytics APIs are retained indefinitely or until the Client or End User requests that their account be deleted. Disclaimer
We have put in place industry-standard procedures to safeguard and help prevent unauthorized access, to maintain data security, and to use correctly the Information we collect online. Unfortunately, we cannot guarantee that 100% of data transmissions are secure. Therefore, while we strive to protect your PII, you acknowledge that: (a) there are limitations to security and privacy of the internet that are beyond our control; (b) the security, integrity and privacy of the Personal Information exchanged between you and us cannot be guaranteed; and (c) any information and data may be viewed or tampered with in transit by a third party.
Third-Party Services
If you choose to connect your APL account with third-party services, you’re enabling Awesome People Leaders and those third parties to exchange information, including PII, about you and your account, to enable the activities of the third party.
If you navigate to third party services through your access to APL and/or connect your APL account with third party services, such third parties may have their own privacy policies and practices regarding data collection, use and disclosure. Please consult each third party’s policies. We are not responsible for the policies or practices of third parties. You should contact those third parties directly if you have any questions about their policies and practices regarding your information.
Changes to this Policy
Awesome People Leaders reserves the right to modify this privacy policy at any time, so please review it frequently. If material changes are made to this policy or if otherwise required by law, we will notify you via your account, by email, or by means of a prominent notice on the Awesome People Leaders website home page prior to the change becoming effective.
Your Privacy Rights and Your Choice
Privacy Rights for Individuals in the European Economic Area (“E.E.A.”)
Under the European Union’s General Data Protection Regulation (GDPR), individuals in the E.E.A. have additional privacy rights:
Right to be Informed. Individuals have the right to transparency regarding Awesome People Leaders’s collection of personal information.
Right of Access. Individuals have the right to know exactly what information is held about them and how it is processed. Right of Rectification. Individuals will be entitled to have personal data rectified if it is inaccurate or incomplete.
Right to Erasure. Also known as ‘the right to be forgotten’, this refers to an individual’s right to having their personal data deleted or removed without the need for a specific reason as to why they wish to discontinue.
Right to Restrict Processing. An individual’s right to block or suppress processing of their personal data.
Right to Data Portability. This allows individuals to retain and reuse their personal data for their own purpose. Right to Object. In certain circumstances, individuals are entitled to object to their personal data.
Rights of Automated Decision Making and Profiling. The GDPR has put in place safeguards to protect individuals against the risk that a potentially damaging decision is made without human intervention.

California Privacy Rights; Other Rights in Certain US States
Awesome People Leaders does not sell personal information. Awesome People Leaders may share personal information with third parties or allow them to collect personal information from Awesome People Leaders products if those third parties are authorized service providers or business partners who have agreed to contractual limitations as to their retention, use, and disclosure of personal information. As a customer data processor, Awesome People Leaders may collect and disclose the following categories of personal information for business purposes: identifiers, commercial information; Internet activity information; financial information; professional and employment-related information; education information; and inferences drawn from any of the above information categories. Awesome People Leaders may collect and disclose this information to provide the Awesome People Leaders products and services to its customers. If you are a California resident, you may exercise certain rights associated with your personal information, like the right to access or delete your personal information. If you are a California resident and would like to make such a request, please contact [email protected]. Awesome People Leaders may request information from you to verify any request before processing. Awesome People Leaders will not discriminate against consumers that exercise these rights.
Further, an authorized agent may exercise these rights for you without penalty.
Further, in the United States, depending on your state of residence, and subject to certain exceptions, you may have some or all of the following rights:
- Right to Know: The right to request that we disclose to you the Personal Information we collect, use, or disclose, and to access the same.
- Right to Request Correction: The right to request that we correct inaccurate Personal Information that we maintain about you.
- Right to Request Deletion: The right to request that we delete Personal Information that we have collected from or about you. (Please note that you may not be able to maintain an Account through the Website without our retention of certain Personal Information.)
- Right to Portability: The right to obtain a copy of your Personal Data that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another controller.
- Right to Opt Out: The right to opt out of the processing of your Personal Information for purposes of targeted advertising and profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.
To submit a request to exercise your rights set forth above, and as applicable to appeal a consumer rights action, you may use [email protected]. We may require that you verify your identity to respond to your request. If you are entitled to a substantive response, we will deliver the requested information to you within 45 days (or will inform you that an extension of such timeframe is necessary). You may make a request up to twice during a 12-month period. We will not discriminate against you for exercising your rights pursuant to applicable state laws.
Children
The Awesome People Leaders website and Awesome People Leaders services are not intended for persons under 18, nor do we knowingly collect personal information from persons under 18. As a business service, Awesome People Leaders does not target its offering toward and does not knowingly collect any personal information from, users under thirteen
(13) years of age; however, if you become aware that an individual under the age of 13 has provided PII to us, please reach out to us.
Cookies
A browser cookie is a small piece of data that is stored on your device to help websites and mobile apps remember things about you.
